Construction Labour Laws in Bihar:
What Contractors Must Know in 2026

Labour law compliance is one of the most under-attended areas in the Bihar construction sector — and one of the most consequential. Inspections by Labour Department officers, audits on government contract sites, and disputes with workers can all expose contractors to significant financial liability and contract termination if compliance is not in order. Here are the key laws and obligations that apply to construction contractors in Bihar in 2026.

Note: This article provides general information. Labour laws are complex and subject to change. Consult a qualified labour law advisor for your specific situation and contract requirements.

The Building and Other Construction Workers (BOCW) Act, 1996

The BOCW Act is the primary legislation governing welfare and safety of construction workers. Every establishment employing 10 or more construction workers (including contract labour) must:

ESI (Employees' State Insurance) Act, 1948

ESI applies to establishments with 10 or more employees where wages are below ₹21,000/month (₹25,000 for persons with disability). Construction contractors employing workers meeting these criteria must:

ESI entitles covered workers to medical benefits, sickness benefit, maternity benefit, and employment injury compensation. On government contract sites, Labour Inspectors frequently check ESI compliance — non-compliance can lead to penalties and even contract termination on sensitive projects.

EPF (Employees' Provident Fund) Act, 1952

EPF applies to establishments with 20 or more employees. Both employer and employee contribute 12% of basic wages each to the EPF account. For construction workers, this means:

Many construction contractors engage workers on a daily-wage or piece-rate basis and attempt to avoid EPF on the grounds that workers are "casual labour." This position is legally risky — EPFO inspectors have successfully argued that regular site workers are "employees" for EPF purposes, regardless of how the contract labels them.

Minimum Wages Act, 1948 — Bihar Schedule

The Bihar government revises minimum wages periodically. As of 2025-26, the scheduled minimum wages for construction workers in Bihar are (approximately — verify current notification):

Always check the current Bihar Minimum Wage Notification at the Labour Department website before finalising your labour cost estimates. Minimum wages are revised twice yearly (April and October) based on the Consumer Price Index. Paying below minimum wage is a criminal offence under the Act.

Contract Labour (Regulation and Abolition) Act, 1970

If you engage workers through a labour contractor (thekedar), both you (as the principal employer) and the labour contractor must be registered/licensed under the Contract Labour Act:

Importantly, if the labour contractor fails to pay minimum wages or provide statutory benefits, the principal employer (you) is jointly liable. Ensure your labour supply agreements contain indemnity clauses and require the labour contractor to demonstrate compliance.

Safety Obligations Under BOCW Rules

Bihar's BOCW Rules (implementing the national BOCW Act) specify safety requirements including:

On government contracts — particularly Railway and NHAI contracts — safety compliance is inspected regularly. Sites with visible PPE non-compliance or unsafe scaffolding can be stopped immediately by the client's safety officer.

Penalties and Enforcement

Penalties for labour law non-compliance in construction include fines (₹50,000 to several lakhs depending on the Act), imprisonment for repeat offences, and — critically for government contractors — the risk of blacklisting from future government tenders. The Bihar government has been increasing Labour Department inspection intensity on government contract sites in recent years.

The most cost-effective approach is always proactive compliance: register under the relevant Acts at project start, pay contributions on time, maintain the required registers, and display all required notices and certificates at the site office.
